This data protection declaration is based on the European General Data Protection Regulation (EU GDPR). It applies to all companies of the ARGO-HYTOS Group based in the EU and Switzerland.

In this Data Protection Declaration, you will learn about which data we collect, for which purposes, and how we protect this data. For questions that are not answered by the subsequent Data Protection Declaration, we have appointed Data Protection Officers who you may contact at any time at the following addresses:

I. Data Collection

We will collect your personal data in the following cases:

  1. Visitation of our website
  2. Contact form
  3. Newsletter
  4. Registration on our download portal PRM
  5. Job applications
  6. Purchase orders, contracts

The legal bases for the collection of personal data may be as follows:

  • Fulfillment of contractual obligations
  • Your consent
  • Our legitimate interests
  • Legal obligations and public interest

Insofar as the processing of data is based on your consent, you are able to revoke this consent at any time and without providing reasons. However, this revocation will not affect the legality of the previous handling of your personal data, which was based on your consent (see ‘Disagreements’ under point IV below)


1. Visitation of our Website

When you visit our website, our server temporarily saves data into a log file, the so-called server log file. This data is deleted as soon as its collection is no longer required to achieve the stated purpose. The following data will be saved:

  • IP address of the requesting computer
  • Date and time of the access/retrieval of data
  • Name and URL of the retrieved data
  • Operating system of your computer and the browser that you used
  • Country from which the access to our website took place
  • Name of the internet service provider
  • Time zone difference versus Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Data volume transmitted in each case
  • The last website page that was visited
  • Browser settings
  • Language and version of the browser software
  • Activated browser plug-ins

The legal basis for the temporary storage of personal data and log files constitutes our legitimate interest. Our legitimate interests are:

  • To correctly deliver the content of our website.
  • To optimize the content of our website.
  • In the case of a cyber attack, to provide the responsible authorities with the information they require to enforce the law.
  • To improve our offering and our internet presence.
  • To collect statistical data.
  • To process orders in our download portal.

2. Contact Form
When you contact us by means of a contact form, your information is processed so that we can work on and deal with your request. If you would like to contact us, the following information is absolutely necessary to handle your request:

  • Last name
  • Company
  • Street
  • Postcode
  • City
  • Country
  • Telephone number
  • Email address
  • Client relationship with ARGO-HYTOS (new/existing)
  • Reason for the request (message)

The legal basis for the processing of data is our legitimate interest in this service. If the establishment of contact helps with the completion of a contract in which either you or the company for which you work is the contracting party or with the implementation of precontractual measures, then this is an additional legal basis for processing the data. Your data will be deleted as soon as its collection is no longer required to achieve the stated purpose.


3. Newsletter

You have the possibility to sign up for our newsletter on our website. Distribution of the newsletter takes place based on your registration via the website. By registering to the newsletter, you thereby provide us with your consent (i.e., a legal basis) to process your data. So within the framework of the registration process, your consent is obtained for processing the data, and you are referred to this Data Protection Declaration.

In addition, the following data is collected at the time of registration:

  • IP address of the requesting computer
  • Date and time of the registration

We collect and process this data based on our legitimate interest.
You have the possibility to deregister from the newsletter and to revoke the consent that you granted at any time. The link to deregister can be found in every newsletter. We will save your data until you deregister from the newsletter.


4. Registration on our Download Portal PRM

When you register for the download portal PRM, you receive password-protected access to the download portal. The following information is essential for the operation of the portal:

  • First name
  • Last name
  • Email address
  • Company
  • Password
  • Repeated password
  • SAP number
  • Serial number

To enable you to download the parameterization software, firmware and initialization (init) files, and in order to be able to communicate with you, we require your name as well as company and address data.
When you cancel your registration account, your data with respect to the download portal will be deleted, subject to statutory storage obligations.


5. Job Applications

When you apply for a job with us, your personal data is processed in order to deal with the application process. This processing can also take place electronically. If we finalize an employment contract with you, the data submitted for the handling of the employment relationship is saved, taking into consideration the legal requirements.
If the application process ends without you being hired, then your personal data is deleted, provided that you did not give us your consent to use your information for further application processes. You have the possibility to subsequently revoke this consent at any time.

6. Purchase Orders, Contracts
If you are listed as the contact person on a supply contract or purchasing order between us and a company or on a contract that we have awarded to a company, then your personal data will be processed in order to complete and execute the contract. This processing can also take place electronically. The following data will be saved:

  • Last name
  • First name
  • Role in the company
  • Telephone number (direct dial)

The legal basis for the processing of this information is the completion of the contract or purchase order. Your data will be deleted as soon as it is no longer required to achieve the stated purpose.


II. Data Transfer

We will only pass on your personal data if we have your explicit approval or are required by law to do so, or if this data is required for use of the website or to answer questions, process contracts/purchase orders, or deliver services requested by you. Furthermore, according to our website, we are able to transfer your data to our distribution partners and the group companies with whom we are associated.
The use of data passed on to third parties is limited to the stated purposes. These third parties are obligated to protect your data and privacy to the same extent that we do. If the level of data protection in a country is not deemed to be equivalent to that in Switzerland or in line with the EU’s basis regulation on data protection (EU-DSGVO), then we will ensure that your personal data is protected at all times according to the Swiss data protection laws and the EU’s data protection legislation by means of a contract.
We will disclose your personal data to the following categories of recipients:

  • Companies of the ARGO-HYTOS Group
  • Distribution partners of the ARGO-HYTOS Group
  • Logistic partners
  • Internet-service providers
  • E-mail marketing partners
  • Credit-rating agencies as well as debt-collection partners

When we employ subcontractors to provide our services, we take the appropriate legal precautions as well as the corresponding technical and organizational measures to ensure the protection of your personal data according to the relevant legal requirements.


III. Duration of Data Storage

We store personal data for as long as it is needed to achieve the purpose for which it was collected or is used, or for the length of time that we are obliged to hold it according to currently valid laws and regulations or contractual agreements. We delete any personal data that we no longer need.

IV. Your Data Protection Rights

When ARGO-HYTOS collects and processes your personal data, the rights listed below are at your disposal: In order to ensure that we do not give your personal data to unauthorized persons, in certain circumstances we may require a proof of identity as well as information regarding your interaction with us.

Information: You have the right to request information about whether and to what extent we have processed your personal data as well as more specific information regarding the use of your data.

Corrections: You have the right to request the correction of data that we have saved about you if you believe this data to be false or incomplete.

Deletions: You have the right to request that we delete your personal data. This is possible if you revoke your consent for us to process your data, if we no longer need your data for the original purpose, or if we are not obliged to store your data for legal reasons.

Processing Restrictions: You have the right to limit the processing of your personal data, e.g., if you question the accuracy of your personal data or would like to limit its use.

Data Transferability: In certain circumstances, you have the right to request that the publication of the personal data you provided to us be delivered either to you or a responsible party designated by you in a standard, electronic, machine-readable data format.

Revocation: You have the right, at any time in the future, to revoke your previously issued consent for the processing of your personal data for one or more purposes.

Furthermore, you have the right to submit a complaint to the data protection regulatory authority in the case of an illegal handling of your personal data. In particular, the data protection regulatory authority that should be considered is the one responsible for your place of residence or your workplace (provided that your residence or workplace is located in the EU).


V. Data Security

We have technical and organizational security measures in place to protect your personal data from manipulation, loss, destruction, and access by unauthorized persons and to ensure the protection of your rights and compliance with the applicable data protection regulations.
The measures taken should permanently ensure the confidentiality and integrity of your data as well as the availability and capacity of our systems and services in the processing of your data. Moreover, they should ensure that, in the case of a physical or technical incident, the data is quickly restored and made available.
In principle, we restrict access to personal data. Individuals who have access to personal data are obligated to keep this information confidential.

VI. Data Analyses (Websites and Social Media)

1. Cookies
This website also uses cookies to track website usage. These are small files that web portals leave on your computer, tablet, or smartphone when you visit them. For the evaluation of usage data (connection data), which helps us to identify trends and improve our online offering, the web analysis tools of the providers listed below are used.
